§1. General provisions
These terms and conditions set out the rules for using the Stan Wody website, available at stanwody.org (hereinafter the “Service”). The publisher and service provider of the Service is Karol Kwiatkowski (hereinafter the “Service Provider”), contact: [email protected]. The User is any person using the Service.
§2. Type and scope of services
The Service Provider provides the following services free of charge by electronic means:
- making available informational content about rivers, kayaking routes, water levels, weather and guides;
- making available an interactive map of waters;
- sending a newsletter – to persons who subscribe to it;
- running an individual account, which allows you to save trips, collect favourite routes, create private notes and publish content in the Community;
- the Community – publishing trips and posts, commenting, reacting, and making connections with other Users;
- private messages – sending and receiving messages between logged-in Users;
- accepting submissions concerning the map – proposals for new places and corrections to places already marked.
All services listed in these Terms and Conditions are currently provided free of charge (§8).
To use the Service you only need a device with internet access and a current browser with JavaScript enabled.
§3. Rules of use
The User undertakes to use the Service in accordance with the law and good practice, not to disrupt its operation, and not to take actions to the detriment of the Service Provider or other users. Providing content of an unlawful nature is prohibited.
§4. Newsletter
Subscription to the newsletter takes place by providing an e-mail address in the form and confirming the subscription by clicking the link in the activation message (double opt-in). Unsubscribing is possible at any time via the “unsubscribe” link in the body of each message. The rules for processing data are described in the Privacy policy.
§5. User account
- Creating an account is voluntary and free of charge. The entire Service is also available without an account.
- Logging in takes place without a password – after providing an e-mail address, the Service sends a one-time link, clicking which logs you in. The User undertakes to provide their own, valid e-mail address and not to share access to the account with third parties.
- An account may be created by a person who is at least 16 years old. By creating an account, the User confirms their age and that they have read the Terms and Conditions and the Privacy policy and accept their content.
- The User may at any time delete the account together with the associated data – from the account settings or by reporting it to [email protected].
- The rules for processing data are described in the Privacy policy.
§6. Content published by Users
- By publishing a trip, post, comment, photo or profile, the User declares that they have the right to do so – in particular, that the photos are their own work or that they have consent to publish them, and that persons visible in the photos have agreed to it.
- The Community is closed – only logged-in Users have access to it. Content published in the Community is visible to all logged-in Users; the User publishes it at their own responsibility. The Service does not make it available to persons who are not logged in or to search engines, but it cannot prevent another User from copying it outside the Service.
- The User retains the rights to their content. By publishing it, they grant the Service Provider a free, non-exclusive licence to display it in the Service – solely for the purpose of providing the service. The licence expires when the content or the account is deleted.
- It is prohibited to publish content that:
- is unlawful, in particular incites hatred or violence, threatens, defames, infringes personal rights or copyright;
- contains profanity or language offensive towards other people;
- constitutes harassment, intimidation or persistent pestering;
- is spam or unsolicited advertising;
- provides false information about conditions on the water – such content may expose others to danger.
- The User undertakes not to publish content that falsely presents routes travelled, in particular in a manner affecting badges and statistics.
- Private messages between Users are available to logged-in persons. The same prohibitions apply to them as in para. 4 – in particular the prohibition of harassment, threats, profanity, spam and unlawful content. Messages are private: the Service does not moderate them automatically and does not read them routinely. Directly within a conversation, the User may block the sender and report them together with a description of the matter, which we then examine (§7). Who may write to a given User is set by that User in the account settings.
§7. Reports and consequences of violations
- Any User may report a post, trip, comment, private message or account that violates the Terms and Conditions. The report is anonymous to the person reported.
- Every report is examined individually. Until it is examined, the content may be temporarily hidden.
- For a violation of the Terms and Conditions, the following consequences are provided, applied in proportion to the seriousness and repetitiveness of the violation:
- removal of the content;
- a warning;
- a temporary account block;
- a permanent account block (preventing further use of the account and the creation of a new one).
- Content containing profanity may be automatically flagged and held for review before it becomes visible to others. The automated system does not remove content or block accounts – the decision is made by a human. Holding is not a penalty and does not mean a violation of the Terms and Conditions; if the flag turns out to be a mistake, the content is published.
- A User whose content has been removed or held, or whose account has been blocked, receives a justification: what the decision concerns, for what reason (with an indication of the point of the Terms and Conditions), whether an automated system was involved in it, and how and within what time limit an appeal can be made.
- An appeal may be submitted to the address [email protected] within 14 days. We examine the appeal without undue delay, no later than within 14 days.
- Blocking an account does not deprive the User of the right to request the deletion of their data in accordance with the Privacy policy.
§8. Fees
- The services described in these Terms and Conditions are provided free of charge.
- The Service Provider reserves the right to introduce in the future additional services provided for a fee. Using them will be voluntary and will require a separate order and acceptance of the price before the conclusion of the contract.
- The introduction of paid services will not cause the functions that the User uses free of charge to become paid without their consent. The Service Provider will inform of a change to the fee rules at least 14 days in advance – by electronic mail or by a notice in the Service. A User who does not accept the change may, during that time, terminate the contract by deleting the account; the change will then not apply to them.
- The prices of paid services will be given in Polish zloty and will include VAT.
- The provisions of the Consumer Rights Act apply to contracts for paid services concluded with consumers, including the right to withdraw from the contract within 14 days without giving a reason. If the User requests the commencement of the service before the expiry of this period, they will be informed of the consequences of such a request before the conclusion of the contract.
- Failure to pay for a paid service does not result in the loss of access to free functions or to content saved by the User.
§9. Disclaimer – safety on the water
The information in the Service (including water levels, route descriptions, difficulty, weather, facilities and obstacles) is for guidance and information purposes only. The data come from external sources (including IMGW-PIB, OpenStreetMap, Open-Meteo) and may be incomplete, delayed or out of date. Water sports and water tourism involve risk.
The decision to set out and to choose a route is made by the User at their own responsibility, after an independent assessment of the conditions, their own skills and equipment. The Service Provider is not liable for damage arising from decisions made on the basis of the Service’s content, nor for the operation of external sources. Always check the current conditions, comply with the regulations and safety rules, and use appropriate equipment (including a buoyancy aid). In an emergency, call the emergency number 112.
§10. Copyright
The Service’s content (texts, photographs, graphic elements, code) is subject to legal protection and belongs to the Service Provider or is used under the relevant licences, with attribution retained (including OpenStreetMap – ODbL, IMGW-PIB data, photographs under Creative Commons licences). Copying and distributing the content without consent, beyond permitted use, is not allowed.
§11. Complaints
Comments and complaints concerning the operation of the Service can be submitted to the address [email protected]. We respond within a reasonable time, no longer than 30 days.
§12. Personal data
The rules for processing personal data are described in the Privacy policy.
§13. Final provisions
In matters not regulated herein, Polish law applies. The Service Provider may change the terms and conditions for important reasons (e.g. a change in the scope of services or in the law); the current version is always available on this page, with the effective date at the top.
